A new proposal is developing in the US Job market to increase the minimum wage requirements for H-1B visa holders. This decision has sparked a debate among all the market experts, employers, and others. The U.S. labour market is in dire need of foreign workers, especially in the STEM (science, technology, engineering, and mathematics) sectors. Each year, U.S. firms that are looking to hire highly qualified foreign workers vie for the number of H-1B visas, which are distributed by U.S. Citizenship and Immigration Services (USCIS).
The amendment is a prime example of the legislative effort to exclude foreign-born graduates with little work experience from the US job market. It was submitted in January 2025 by Senator Bernie Sanders (I-VT) as part of the Laken Riley Act.
What is an H-1B Visa?
Currently, the H-1B visa program allows US companies to bring skilled foreign nationals to work in it in occupations such as information technology, business management, engineering, and medicine. H-1B visa holders must be paid at least $60,000 per year, regardless of their occupation or geographic location. The proposed changes would require employers to pay the foreign professional at least the “median local wage” for the position. This could cause entry-level salaries, such as those of a newly graduated software developer, to be at or above $80,000.

Due to a low statutory ceiling on the number of available H-1B visas, demand has recently exceeded supply, and the limit was exceeded before the year was over. According to research, H-1B employees increase employment prospects for everyone, cover employment gaps in many STEM sectors, and supplement U.S. workers. Similar suggestions are anticipated to be discussed as Congress contemplates more comprehensive immigration reforms this year, even though the Senate did not vote on the plan. The one who supports this wage hike stays positive as they think that it will undercut the foreign labour hiring and companies will create more opportunities for US workers.
On the other hand, the critics, including the National Foundation for American Policy, say that this change will make it expensive for US employers to attract foreign talent in order to bring an increase in the US economy.
